In New York State Article 32 of the Labor Law outlines the requirements related for mold abatement and assessment (inspection), inclusive of mold growth exceeding 10 sq. ft. in an indoor space, as well as the requirement of landlords and property owners to maintain a safe and habitable environment for habitants. In such instances (of mold growth exceeding 10 sq. ft.) a licensed professional is required for the assessment and removal of mold infestation. For infestations less than 10 sq. ft. these can often be cleaned by the home or building owner.
It is extremely important to hire a licensed professional for assessment and removal of mold (in applicable cases), as improper removal attempts can not only result in spread of contamination, causing further infestations , but may also lead to adverse health in building occupants.
The first step in hiring is to find a qualified, licensed professional. Typically a mold assessor will come in first for evaluation. The assessor will provide a written report of the findings, which will outline the probable cause of the infestation, remediation requirements necessary for final clearance and an estimated range of what the abatement work will cost. At the time of service the professional should provide proof of license, active and unexpired. In the event the mold assessment professional determines remediation is necessary (which will be documented in their assessment report, required by law), a mold contractor will need to be called in. The same company/person cannot perform both assessment and removal in NYS on the same job. Upon arrival the remediator should present their current, active license, as well as the licenses of any staff performing remediation work on site (at the time of service). They are also to provide an outline of the scope of remediation work planned, inclusive of materials, labor and safety measures to be taken to prevent the spread of mold.
Once the remediation work is completed the mold assessor is to be called back in for final clearance. The assessor will then review the work performed, the remediation plan (as provided by the abatement company) and grade a pass or fail on the final assessment. In the event of a failure (which is uncommon) the assessor will provide details on further steps to be taken.
